Looking for a lawyer to draft a demand letter. Civil matter with home builder. Edmonton area preferred. Anyone on here a lawyer or any recommendations?

No, Demand Letters do not work. All it does is give evidence of denial of payment, which the Account itself does if you are a Sub Trade and unpaid.

I need to know the facts, as you may have a limitations issue, or a Builder's Lien time deadline for filing of a Lien at Land Titles if that is the issue.

DO NOT fall for the story that they pay on the 2nd Friday and last Friday of the month and you just missed the "cheque writing deadline", but you will be paid next month.

I hate Home Builders for all the B S I have seen.

One time someone called from the Bank claiming to be the Accounts Manager and saying the Construction Mortgage Advance could be released regardless of the Deficiency from the Building Inspector. I told the person to send the representation on Bank Letterhead. Never came.

I Faxed to the Bank and the Manager talked to the Staff Member, who had no clue who the Builder was or who the Borrower was.

Apparently, name on the desk and the business card was all the Builder's friend needed to try and B S the next advance from my Office.

I called the Builder and told him the matter was being forwarded to the RCMP for a Fraud Investigation as the Bank Employee was being impersonated on his behalf.

The deficiencies were corrected the next week.

Then when it has not been complied with you can show the lawyer that you need it has been done.

Lawyer will want to do his own ( billing you of course ) but at least you have tried.

If the amount is less than 50k you may be able to deal with it in small claims court.

On a more serious note. One of my condos (rentals) hired a high powered real estate lawyer to sue the developer. We sent a demand letter. 30 day response period. Our lawyer disappeared. We sent the letter with clear directions what was yo happen after 30 days and nothing happened. Our demand letter looked weak.

Every email or call to him cost us $450. Just to sort out wtf was happening after our demand letter cost a crazy amount.

Keep that in mind. Your lawyer will bill you minimum $450 and hour. Everything he does costs you $$$. 5 min call? $200. Responded to an email? $200. Negotiate a settlement? 5k to 10k.

I had a lawyer handle a negotiation for me one time. Realized real quick that was a mistake. Waste of time and $$$.

Years ago the last guy that owed me on a long due bill as a last ditch I went down to his office. Long story short I had all the office stuff and computers I needed.
